Not too long ago, I bought a holster from Blackhawk Kid after it had been posted for sale for a couple of days (excellent transaction, BTW). Thing is though, I bought it after other forum members had expressed their interest by asking questions about it. Just from a response which was posted afterwards, it seemed that someone had gotten their feelings hurt. Since that time, I've noticed other sales transpire with similar things happening, usualy when someone posted an "I'll take it" after one or more forum members had posted a "PM sent".

After being both a buyer and seller here for years, I've learned that a "PM sent" to a buyer could be anything, or it could be nothing ( as far as completing a sale goes). Point is, except for the sender/reciever, no one else knows what that means, nor should anyone else be expected to.
On the other hand, a publicly-posted "I'll take it" to the thread is self explainatory. To me, that perty-much seals the deal unless something unforeseen comes up later. I'm perty-sure that it means the same to everyone else too.
What I'm trying to get at here, is that although I'm sure that none of us want to appear rude or greedy, I'm quite-sure that none of us are mind readers either. Perhaps that is something that the seller needs to bear in mind while describing the item being sold, perhaps it's something that a prospective buyer needs to bear in mind while PM-ing questions, perhaps both. After all, communication is key is it not?....and what the rest of us don't know, we don't know....but we all know what "I'll take it" means, eh?

When selling, I usually specify that "first I'll take it followed by a PM gets it". That way, the forum membership knows it is taken and it is confirmed by the PM that should follow. If someone only states "PM sent", it means there is discussion occurring with no obligation to buy or sell.

I have lost a few items while discussing a trade or waiting on pics, no big deal to me. I figure the seller has the right to sell to whomever he chooses. :D
 
I have been down this road with the very same approach as you DGW, in an effort to get something in the selling rules to state the first "I'll take it" get's it. I was shot down by more than I can count and for no logical reason, other than the frequent posters didn't want it. The secrecy of "PM sent" could mean anything but you as a buyer, must assume it means you didn't get it. Sad but true
 
First person that actually says I'll Take It wins IMO.
An offer is not a sale till accepted and a question is exactly that. ps

Ask all you want but that should mean now be implied you have first rights to the item
You could tie up an item for days asking questions

Whereas "I'll take it" to me means IT'S OVER - Deal Done - Agreement Made
 
I'll weigh in here too--since I may have been a feather ruffler on the recent transaction referenced. I'll also admit some legal training on the subject--although feel I forget more and more every day that passes with most my practice outside the commercial/contract environment.

As a general principle, when anything is offered publicly for sale, it gives the consumers the cool/neat power of acceptance--hence the "I'll Take It" being an important response. Any offer for a different price, different shipping method or even payment plan, is by definition a counter proposal--so no acceptance or binding agreement. When you make the counter proposal if set out that way--say like I'll trade this or that, or I'll take it if you include shipping--gives the seller the power to accept your counter offer to bind the agreement. If things are sent in PM, which if a counter offer or trade offer or tire kicking it should, the item is still offered publicly for sale and every person seeing it has the power of acceptance to bind the deal.

In today's internet age, the best way to avoid conflict is to simply follow the legal principles used for centuries of transactions--and the best way to do that, first I'll Take It trumps. PM's can truly mean anything, from tire kicking, to trade offers, to counter proposals--all of which are fine, but none of which bind the agreement or take another consumer's ability to bind the offer by an acceptance.

In practice it works well too. I have PM'd folks--the item may not have been worth the asking price to me, or was unclear on shipping or I wanted to trade. I knew very well when I sent the PM that the item was still fully up for grabs. I certainly wasn't intending to derail another sellers ad by asking the question or making the offer--only making it clear that I had some interest of some kind and directing the seller to check his PM's. As a seller, I certainly wouldn't want potential buyers to sway away simply because someone had earlier sent me a PM question/trade/whatever.

In the deal last night, I wasn't trying to cut anyone off or jump in line. I simply saw a gun I had some interest in. I saw that no one had spoken for it. I did see that someone had sent a PM and unsure about what. Wasn't trying to be discourteous--hell, I even posted a warning that my lust for fine firearms may weigh over my lack of need for the gun. I did so with the intent of looking back today and if not spoken for, to take it. 12 minutes later changed my mind and offered to take it. Everything worked as it should. The offer was out there. I accepted it. No harm, no cutting in line, no dibbsies, just a normal transaction.

I buy and sell enough custom guns to know its a more limited pool of folks, and regardless, try my best to be courteous and honest with all--but never try to cutthoat my way to a gun--none of them are worth that. But, it should be known if there is a gun or heck whatever that interests me, a PM doesn't mean anything other than a question of some sort was sent. Always figured that was more for the seller or original poster than for other possible buyers/readers since the rest of us have no clue what it would have pertained to.

Thats my .02 and soapbox all in one.
 
How about an " I'll take it " through a PM.
I have bought several things of this sight and never once made a post in the add.
Personally I don't care for every Tom , Dick and Harry knowing what I buy or sell.

It's a matter of common courtesy to let others know it's spoken for. Tom, Dick and Harry otherwise wouldn't get their hopes up thinking they are the first to reply to the ad. There is nothing intrusive about consideration.
 
I've been including "the first 'i'll take it' posted here, gets it" in my ads for a few years now... helps separate the shoppers from the buyers and makes it easy on me and those looking.

It would be up to the seller to let Tom Dick and Harry know , not the buyer.
That is how it worked every time I purchased something.
If it was sold through a PM the buyer should say it has been sold in the add.
Then Tom , Dick and Harry won't be getting their hopes up.
How many adds have you seen where they say it is posted on more than one sight ?
Who gets it then ?
The first one on this sight , the first one on the other sight or the first one buy the time line ?

The exact same thing has happened to me as a seller. Questions back and forth when another person posts a reply stating "I'll take it." Well guess who I sold it to and guess who got upset.


You're right. I didn't know either member and dollars are dollars.

Also, I would like to add that questions and offers should ALWAYS be done via PM.
As should critiques that disparage a poster's item. Anything else is just plain rude.

First "I'll take it" prevails. If you feel a need for anonymity, send a PM that says you will take it, and ask the seller to not disclose whom they have sold to. Just don't expect the seller to ignore the public "I'll take it" that was posted after you PM'd him, but before he read his PMs and posted sold. The guy who posts "I'll take it!" for all to see should prevail in such a situation.

I don't really see what the big deal is.
If you say you want it wether it be PM or publicly and the seller responds with " It has been sold " then move on.
I have been on both ends of this and it never bothered me.
Another one will pop up down the road somewhere.
 
Well I am a believer that the first "I'll TAKE IT" gets the prize.....

Sure you can announce you sent a PM but an "I'll TAKE IT" should still trump the "PM sent" as as far as I am concerned it is still for sale at that point....even if the PM says I'll take it....YMMV...RR
 
In general, most folks use common sense, and honest business practices. A public forum, where anybody can see it, causes issues occasionally.
In general, the first; "I'll take it," wins out as most have stated above. Even when posted on more than one site. An honest seller will look at the time stamp & allow the first to post an I'll take it to prevail.
And as noted above, a "PM sent" can mean just about anything.
The best is; "I'll take it & a PM to follow."
Common sense.
Folks who send a PM with an "I'll take it" w/o putting it in the post, (those who do not want anybody to know their business,) can cause a bit of disappointment to a poster who does so in the post. Again, the time stamp by an honest seller usually rules.
One thing not mentioned here is the fact that an item can be offered for sale, yet the seller may not be able to get back on their computer immediately after someone posts an "I'll take it." Life does have a way of keeping us away from here.
Again, common sense, & use the time stamp.
A good example was recently an item was posted for sale & I posted an "I'll take it" in the ad, and the seller responded he'd already sold it to somebody about 10 minutes after he'd posted it for sale. The seller had not had the time, or possibly not taken the time to post an "SPF" for it.
Was I upset that I didn't get it? NO!!!! Should the seller or buyer posted info about the sale? Hopefully yes, but no it wasn't done. I wear big boy pants & realize that not everyone is going to be as good about posting such info so as to let us all know a deal has been struck.
But, just a "PM sent" can mean anything.
 
First of all, let me again say NO ONE did anything wrong on the thread where Tim sold his Bowen .500. I was just giving Will crap for not acknowledging my post of "PM sent", but he doesn't have to acknowledge it. In Will's shoes, I'd of said, "I'll take it" also, but I'd of done so knowing that there's a possibility it might already be going to the first guy to speak up and say he's sent a message to the seller. This lets the other guys on the board know there is already an offer, (in my case a trade offer) out there for the seller to consider. It's up to the seller whether he takes the offer from the guy that PMd him FIRST or sells to the first guy to post an I'll take it, especially when the seller makes NO STATEMENT saying an I'll take it trumps all. THAT is the seller's choice. An "I'll take it" doesn't ALWAYS trump a PM. It trumps it if THE SELLER SAYS it does :D
 
Everyone wants to make a rule. *sigh*

In a polite world, and on a FREE forum, An I'll take it" should be fine. If the buyer then renigs or is otherwise unreliable, the seller still gets a FREE posting to reconsider a sale.
 
The item belongs to the seller and he can use whatever method he wants to determine who gets it.

However, if I am purchasing something, it is my money and I will use the method I choose to buy something...my buying method will not be dictated by the seller or others on the forum. There are times that I have a reason for not posting the "I'll take it" and I just send a pm. If the seller will take that, fine...if he will not, that is fine, too. Close to half of the items that I have bought off the forum have been by pm.

Y'all do it however it works best for you and I will do likewise...everybody will be happy. :D
