PHOENIX (3TV/CBS 5)--- A man has died after a homeowner shot him as he and another man attempted to enter a home in Phoenix early Saturday morning.

The incident occurred just after 1 a.m. near 19th and Peoria avenues.

According to Phoenix police, two men attempted to enter a home.

That's when the homeowner, who was armed, fired a weapon to stop the men from entering the home.

The man, later identified as 34-year-old Michael Ahumada was killed. A 33-year-old man was transported to a hospital, where he is listed in critical but stable condition.

No arrests have been made. It's unknown at this time if the homeowner will face charges.

In a brief interview with Arizona's Family, the homeowner pledged to fight anyone else who tried breaking into his home.

[*]Both intruders were Unlawful migrants. Followup news story on CH.3.

Reading the comments at the link it seems there's a fair number of snowflakes in Phoenix whining about this old guy shooting these 2 dirtbags.

It sounds like a righteous shoot against home invaders. At his age he doesn’t need to be physically attacking them to protect his home. Guns are great equalizers!

I've read a few comments on other sites about whether he might be charged. From what I've found out, he won't be. AZ has a pretty good Castle Doctrine, much like ours in MS.

AZ CCW Permit » Castle Doctrine

In general, the following conditions must apply if the Castle Doctrine is to be used in claiming justifiable homicide:

The intruder must be attempting to or have made unlawful and forcible entry into an occupied home, business or vehicle.
The occupants must have a reasonable belief that the intruder is entering with the intention of committing a felony crime such as burglary.
The occupants must have a reasonable belief that they are in danger of serious injury or death at the hands of the intruder.
The occupants must be innocent of any provocation and cannot have instigated the intrusion or initiated the event by a threat of deadly force.

Unfortunately you are correct. The only (that I can see) saving grace is that
most of the snowflakes are nestled around the universities. Get more than
ten or fifteen miles away, and the density (double entendre intended)
diminishes quickly.

BUT golly-gee-whiz . . . . deys wuz probablied lookn fer a cup o coffee.
