This should be interesting even for Texas. A man is shot and killed while chasing the man who stole his son's truck. The hijacker is pleading self defense.

2023: Records reveal that Hogan was also on deferred adjudication for assault of a family/ household member impeding breath/ circulation. The charge was filed on November 12, 2023. He was issued deferred adjudication.

March 27, 2024: The case status lists Hogan as pending completion of probation, according to the documents.

His criminal history also includes prior felony cases involving burglary, auto theft, and drug possession.

Records show several other charges that have been dismissed, including felon in possession of a weapon and child endangerment."

Agreed. Years ago during a road rage incident in Miami two drivers stopped, one driver went to the second car with a gun and pointed it into the window. The guy in the second car took the gun away from the first guy and shot him with his own gun.

The second guy was convicted of manslaughter because (paraphrased) once the first guy was disarmed the second guy killed an unarmed person.

You can't claim self defense when you shoot someone during a crime.

This is like an armed robbery of a convenience store. If the clerk were to produce a weapon, the robber can't shoot the clerk and claim self defense.

I agree that the father should not have tracked down the carjacker. That was extremely stupid not to call the police. But it doesn't change the fact that the carjacker committed murder to prevent being caught.

The one I remember reading about was different.... road rage, two guys get out and come at the guy in a car with weapons drawn.... guy in car kills one of them and wounds the other.. wounded guy is charged with the 'murder' of his partner.....

But it might open a quagmire of legalities if one was forced to shoot the guy who stole the car. A better option would be to call the cops while keeping the car under surveillance prepared to intervene if they didn't. And be prepared to engage the BG (hopefully with some help).

Ya …. I fully know that law. That law doesn’t really work for stopping a person who’s running away from your property. Unless maybe at night where he still has some of it.

Now if you were certain the person running away was the same person who committed an armed robbery and still presented a threat to others then you might be justified.

But even in TX shooting at people fleeing a scene is legally problematic for a CCW holder unless they have a reasonable belief that person continues to present a threat to themselves or others.

Better to let the cops handle someone fleeing the scene except in a few special circumstances.

Lady here in town had her car stolen ... two days later she's driving in town and sees her car, she calls the law and tells them she is following her stolen car and they really don't respond .... person driving the car stops and goes into a store and she is telling them where the car is parked and where the driver of the stolen car is and then still won't respond.....

ahh hell, I can top this easy - - - around 2012, my daughter had her vehicle stolen, a very distinctive Chevy S10 xcab, with a bed cap, and cool rims. Three weeks later her bank calls and says it's in an impound lot after being recovered. The police agency that found it just entered it into the system as recovered but never notified her. The agency for the city where it was stolen cleared it from their system without notifying her. So, she had to pay a recovery fee, and impound fee, and a bank loan surcharge fee, totaling around $800 to retrieve the vehicle.
So anyway, as we're retrieving the vehicle we're cleaning it out of the trash they left in it, and low-n-behold as I look under the passenger seat there is a purse. So, I check the ID, do a bit of an investigation myself, and track down the girl. She gives up the guy she was with who stole the truck. I locate the guy, give him a call, and have him meet me on the pretense that I want to do a drug buy. But, I make the meet just a couple blocks from where he stole the truck. Now, imagine his surprise when I walk up and identify myself and show him my nice shiny handcuffs.
Members of my own police agency booted this whole theft investigation. One lost their job, and two got suspensions..... one of those suspensions should have also been a termination
The only plus side of this was that we filed a penalty recovery suit against the thief, which to our amazement he actually paid off. Not sure from who, where, or how he stole the money he used to pay it, but my daughter was made whole on those expenses. Phewwwww..........
