Deal should have been, if you’re not going to do this temporary job in your allotted time spot and do it without biching then you get to stay home, without pay of course. Caving in this BS is a big part of the weakness and failure this country is experiencing today. Also bad for morale of the your company. Bad, weak employees need to up their game or get out of it.
 
I don't get how, "Put some muscle in it.", is sexual harassment. It seems you have a DEI hire & DEI management.
I do remember the first female sheet metal worker I ever met. She was hired by the company I was working for when I was an apprentice. All the old guys were happy to have a female, any female working there. One of them asked her if she had ever had any problem with sexual harassment. She told him, "Just once but they talked him into dropping the charges."
 
Long hair & loose clothing can get you hurt. I started to give some examples of things I know of that have happened but it is probably better I don't.
I worked in a machine shop and they had a girl running the large drill press. She was told to tie her hair back when running the press and she did except for one day. On that day she forgot and her hair got caught in the spindle. It wrapped her hair around the spindle then tossed her against a cabinet. It pulled her skin off her head and part of her face before she dropped to the floor. One of the other machinist guys saw this and ran over and shut off her press. Called 911 and the docs at the hospital replanted her skin but had to cut off all her hair from the skin. She came in to work the next week and took off the wig she was wearing and put it on a nearby table. I guess she figured the press wouldn't take her hair anymore. But she was bald for several months after that.
 
At work the regular trash removal man on my shift is off for a few days on vacation. The job is being rotated between other workers in the job classification. 2 of the people filling in have no problem doing the job.

The 3rd was whining about having to do trash removal and someone said "Come on, put some muscle into it".

That was all that was said and the kid turns around and claims sexual harassment...

I will be interested to see the outcome but it blows my mind that someone would think they were being harassed by a simple statement like that.
The issue is they don't want to do it. Harrissment is just the first thing to come to their mind to get out of it.
 
.....and that type of mindset is, in part, exactly why we have the problem nowadays of some people being offended over the slightest little word, phrase, look, etc. that they or others (such as yourself) have deemed that they must find offensive....when such things should never be construed as being so. The thin-skinned & those who've decided to be perpetual victims should never be coddled. The world's a tough place. Everyone should have a helmet. I've had mine since I was a kid, most others have too.

You're not the only one who's 'been around the block' a few times or has decades & decades of experience in various workplaces or in life in general. Your contention that "women often had to bed the male boss in order to keep their jobs" is ridiculous & is mostly an urban legend, not near as prevalent as some proclaim, once we got out of the 1950's & has relatively little to do with this day & age. How many women can you list that you have actual knowledge of that found themselves in that position, compared to those, to your knowledge, who never did? Enlighten us with facts & specific cases, pls, not rumor perpetuated by tales form Hollywood productions, water cooler or cafeteria chatter, the neighborhood grapevine, or other such unreliable sources. Additionally, if you believe that any female who was the recipient of the phrase 'C'mon, put some muscle into it' has a legitimate & actionable sexual harassment case, easily winnable, as you put it, then your beliefs are ridiculously & unreasonably restrictive when it comes to our 1st Amendment rights. I hope you never had any role in H.R. or in any other company position & was responsible for implementing such ridiculous policy, rules or regs. In case you haven't noticed, you're the one & only in this thread who has the opinions that you do. That should be a clue to you that perhaps your perspective on the matter might be well served with some re-revaluation.

Well thank you for insinuating that my post was a fabrication. In reality I have seen a lot of men fired and recently. Just before I retired back in 2012 I saw two men fired for sexual harassment at two different companies that I worked for. The men in question were brutal people who even their male companions loathed and we all cheered when both men were fired for harassing the women. One was a supervisor. Both men thought they could get away with sexaul harrasment of the females that worked there. The females in question went right to management as was their right to do so. And we all knew that the females were not exaggerating or making things up. I was surprised both men actually got away with it as long as they did. Witnesses sealed their doom as they were dumb enough to brazenly do it in front of other people.

Again more proof things are better today in the treatment of women than it was in the past. My warnings of caution though when dealing with women are still valid. It's often been said that you are a fool if you dabble in romance or harassment in the workplace.

And your statement that I do not fit in with your philosophy was actually a compliment.

You have not stated "why" management ruled in favor of the young man and I am now assuming he was male as you do refer to the employee as "He".

Management is well aware of the fact that if you unjustly let one employee get out of not doing a job simply because he does not want to do it then others will soon do the same thing. Management must have ruled in his favor because of some physical or even psychological problem he may have.

The young man in question could have been recovering from an operation.

The Young man may not have been physically capable of performing the job.

The Young man may have a learning disability,

I only mention just a few reasons the company may have ruled in his favor. We have not heard "why".

None of that has anything to do with your prior allegation that women have to sleep with their male bosses in order to keep their jobs, which I asked you to substantiate with factual knowledge of such occurrences. I notice that you didn't even attempt to address that request & I have no doubt that we all know why. I suspect that your new claims carry the same factual weight. I'm happy that you've apparently played no role in the moronic & unreasonable implementation of any of the modern day policies that limit the free speech of any employee while addressing another, as I'm sure that you would've told us all about it if you had.
I've lost interest in our back & forth over this. We've both had our say & it's no longer going anywhere constructive so I've become bored with it.

Becarefull he now knows he can cry to hr s as get what he wants. I have been in this situation with another employee. Only talk to him when you have to only when needed for work act like he is not there no hellow good by how’s the family or what sports team is doing. If he try’s to engage you in small talk act like there is no one there don’t respond except for work related stuff. It will drive him crazy that no one will be his friend . I seen them quit because no one will talk to them

I referred to it as he, it wears black nail polish, eye shadow and lipstick. All I know is that the kid was taken off of trash removal and put somewhere else. In some cases I believe complaints are handled just to shut the complainer up.

I don't know the details of how it was handled but the kid got his way. I stay as far away as possible from the kid because I don't want to be involved in any way. Some people are toxic and this is a good example.
 
I have a condition called Asperger's Syndrome. They now lump it under a high functioning autism, but we don't really share most of the normal autism symptoms. I'm an HR nightmare.

Aspies tend to just plainly state facts. We can't see it as anything but a fact, so don't really recognize that people have "feelings". We also don't have an awareness of "socially acceptable" ways to state the facts we observe. So if I point out that someone is an idiot, it's not because I am being mean or abusive. It's because they are an idiot. I can't help it.

I've had people complain about my statements of pure facts before, but with the ADA, there's really not much HR can do but tell me it's inappropriate to tell people the truth about themselves.

I really don't talk alot at work or in any public settings. I get uncomfortable around too many people. But nobody who knows me asks what I really think about the situations that they get into. At least not twice

They did him a favor and saved the company a workman's comp claim. Maybe they should have given him a hair net.

Work with a guy who got his neck tie stuck in a commercial sized paper shredder. Almost strangle to death. After that 100% bow ties. (Not Chevys)

One of my best friends has a son with Asperger's Syndrome. He is a mental health counselor at a hospital and very good at his job. He also rehabs houses and turns them into apartments that he rents to travel medical people that work in the same hospital that he does.

He put himself through school while working full-time and had his masters degree in his early 20's. His degree is a Masters in Social Work. He had scholarships and paid for the rest of his education without loans. The kid is great with money and honest to a fault.

He was dismissed from a job during the probation period for supposedly harassing someone who took a dislike to him. It was a bullshit claim that he could have fought using his Asperger's as a reason but he didn't like the work atmosphere and voluntarily resigned. He went from a school to the medical field and is much better there.

You are right about him telling it just like it is!! I admire him greatly for his honesty and work ethic. He will do well in life.
 
Perhaps a 'job description' sheet for each employee would be the answer. In the Army on your yearly enlisted evaluation your specific assignment/position was stated and then there was the" catchall" phrase "and other duties as assigned"

Now you are twisting what I originally posted. I never said that today woman are often required to sleep with the boss, that was the way it was in the past and that is common historical fact and now that we have laws against this today it much better than it was in the past. All women and many men would agree about this. No one should want to go back to the past.

Women are still harassed at work and I gave you examples of this which you now seem to reject as fantasy because it is against your own beliefs and now again your are stating that my post is a falsehood. It would not be polite to start naming the specific people I alluded to as that would be an invasion of their privacy and even enters into legal grounds. That should be obvious to you.

There are always two sides to every story and to understand that you must be skilled in the ability to think critically. I have pointed out that we do not know the full story of the man or woman who claimed sexual harassment which was the original subject of this post.

I have respected all sides and viewpoints in this post and not attacked anyone as you have done to me. I am also surprised that management allows politically charged statements like "snowflake" to be used. Its offensive to many people including to many gun owners.

In our shooting club of over 1,000 members we have conservatives, liberals, Democrats and Republicans. These days with more and more attacks on the Second Amendment we cannot afford to start alienating our fellow gun owners and driving them into opposing camps. Falling victim to Divide and Conquer is sure death for any group of people.

I would say that if was a girl no matter what ethnicity and the person talking to her was a man She has a damn good case that will probably win.

When I worked in industry I was always very careful about what I said to women. One day they might laugh and the next day be offended by the same remark so caution was the best route to take always with them.

Women seldom want advice they just want you to listen to them complain as it makes them feel better. This statement came right from many of the women workers. Just have a concerned look on your face and say nothing or as little as possible.and nod always in agreement with them and they will think you are the ideal work companion.

If you speak to women like you speak to men you will find yourself in the unemployment line very quickly. The above case about taking out the trash was a classic example of speaking to a woman like you were speaking to a man (assuming the person in question was a woman that was complaining)
I was a facilities manager with an admin section comprised mostly of females.....my maintenance departments were (at that time) all male. The women filed a sexual harassment complaint with me that the men had 'girly' calendars in the shops. Of course I had to have them taken down.
Shortly afterwards the men came to me and filed a similar sexual harassment complaint that the admin women had Chippendale calendars hanging in the office area that offended them.
You should have heard the wailling when I told the admin group to take their calendars down......fair for one was fair for all.

After a few days everyone settled down and was back to "normal".

After reading some of your other comments I wouldn’t be surprised if the other worker commented on his kitty nature or referred to him as an English cigarette. Guy to supposed guy, that doesn’t rise to the nature of harassment to me.
