Non Lethal self defense can still get you in trouble

Maybe its best with just one side of the story.

We had a friend where one night a burglar removed jalouse glass and tried to scoot into a floor level window. Once the leg was inside the three-legged dobie got it and would not let go. Burglar on the outside leg on the inside being yanked and pulled with privates hitting the window frame many times. Police came arrested the burglar and he sued and collected for damages to his leg and posterity.

My GSD bit a guy who climbed our fence and was attempting to break into the house. He tried to kick her so she bit him. He sued and we had to pay. Judge told us that if your dog bites someone, you are at fault, period. I called him an idiot which probably wasnt helpful

A dog attacking someone is not self defense. It’s more like setting a trap.

Sorry I was commenting on the 2 dog bite stories.

I didn't realize the blind link was there. That story makes me sick. That kid deserves a medal.

Hope the judge and jury have enough sense to throw this out, and leave the guy open for a countersuit.

Oh how that things changed. Dad worked nights. That left mom and us four kids home alone. Alone except for my 125# Standard Poodle. Polo was not some little yappy ankle biter. In fact he was a biter of any kind. One night someone tried to get in through the sliding glass door ( the doors had been installed backwards throughout the area with the slider on the outside). Polo had a habit of sticking his head under the drapes and had left a mark that my mom always complained about. So when the fellow tried to get in Polo lifted the drapes and let out a low growl. One no one had heard before and woke me up. We found the door partially removed.

When dad got home he fixed the door and said next time let the dog out. A few years later pretty much the same scenario played out. I let Polo out through the garage. He apparently got a piece of the guy as there was blood on the back wall. Cops came and said it was too bad he hadn't just held on, it would have made their job easier.

My son and his in laws were robbed after stopping to get a bite to eat after looking at Christmas lights. The guy stuck a gun in his BIL belly and then saw the others in the van and said Imm robbing all of you. Gave brother-in-law chance to get his gun and the guy ended up getting shot. The cops asked why did you do this. He said we just came into town to earn a little money. He currently living free of all monetary obligations' courtesy the taxpayers. And his colostomy bag makes him a real hit with the rest of the in mates.

The sad thing is that he likely isn't saying, "Damn, I fugged up." He's probably saying, "That sumnabitch shot me!"

I had no problems. One of the few good things about NJ is that the Castle Doctrine is in full effect and is almost never challenged. I messed up an armed intruder's knee permanently in my house. Police reply: Good job! The same would have applied if I had shot him. All a matter of state laws.

Florida is pretty good about that as well Stand your Ground and Castle Doctrine. Some counties are better at following that than others,

3. If you live in a "stupid" state you might actually be held liable in a civil case or in jail in a criminals case.
4. People get the quality of government they deserve and support.

In Florida if you are not charged criminally there can be no action civilly against you in a self-defense situation.

When I saw this I was thinking of all the non-lethal defense adds like Byrna and the other one. If he had been shooting the kid with one of those same result. or if the assailant had a reaction to the tear gas and went into shock. Its not as all that wonderful as claimed.

Even without a specific "castle doctrine" I believe we are on solid ground defending ourselves in someone breaks into our home with obvious ill intent. If someone broke in my dogs would guarantee they would drown in slobber. I'm not sure how the courts would view that.

Dad has always said, if you have to shoot in self defense, shoot to kill so they can't sue you afterward.

Florida says if you are not charged criminally, no one can sue you civilly in a self-defense shooting.

I equate that a civil lawsuit by a dead perp’s family is a continuation of robbing the innocent victim.
