Question on/for FFL

It's just legalize to make sure all the appropriate boxes are checked.... and the potential of not getting a refund is just covering their rear incase some idiot tries to order something not legal in their state..... but the reality is anyone including an FFL can go on line with the BAFTE and check and make sure they are shipping to s currently licensed dealer.

As an ffl, I don't give non-ffls a copy. Even ffl's don't technically need a copy, just your license number. If you purchase on GB, you can select an ffl at checkout, and they will send a copy. Otherwise, their chosen ffl will reach out to me, and then exchange copies. Not sure about no refunds. You should know if it's legal to own in your area.

I'm just speculating but the 'no refund policy" might be because of this.... So, your FFL receives the gun and realizes it is not legal in your state... what do they do with it?
I'd speculate they would ship if back to the original shipper COD? not really sure... but heck depending on the state they might actually have to turn it in to be destroyed....

Any FFL's here know what to do in this situation?

I make many transfers from GB and other sources. It is customary for the receiving/transferring FFL to transmit their FFL to the shipping/selling FFL. The shipping FFL usually includes a copy of their FFL in the package. Having a copy of the shippers FFL is a convenience to the receiving FFL for their entry of the item into the transferring FFL's "Bound Acquisition and Disposition Book" and for their records. The transferring FFL doesn't necessarily need to receive an item from a licensed dealer but having documentation from the shipper establishing their "bonafides". Typically, the non-FFL sends a copy of their driver license and a copy of their concealed carry permit if they have one. Some FFLs will not receive an item except from another FFL (their option). I am listed as a transferring dealer on GB, typically I receive an email from GB advising me that someone has chosen me to complete a transfer. GB supplies the individual's name. GB transmits my license to the shipping FFL.

I recently had a firearm sent to me by mistake. I contacted the shipper, informing them of the mistake, and a scenario to pay me for the return shipping.

When buying my FFL is on Gunbroker's FFL Network. Just click on his name and have never had an issue. When selling I require a signed copy of the FFL. I don't care who sends it because I verify it anyway.

I've wondered about this as well and would be curious to find out .

Or another close scenario, a person buys and pays for a gun online, has it shipped to an FFL, but then is denied because of the background check.

What happens to the gun then? Does the buyer get his money back? Can he/she sell it?

If you choose a receiving FFL who has their license on file with GunBroker (not all do, of course), then after the auction closes, the seller can download a copy directly from GB from their "Sold Orders" page.

If they actually open the "order", the receiving dealer's phone and email address are listed so they can be contacted in advance if needed. The digits of the FFL number that EZCheck requires are also listed, though that is moot since the entire FFL is downloadable.

unfortunately none of the above matter to this seller, as i stated, the only thing he would accept had to come direct from the receiving dealer

any ways I think this topic has been pretty much hashed to death , so thanks to all that responded, have a good evening

I said I knew that and that Is one reason i told him to go pound sand , If I have to have MY FFL guy send his FFL separate from my payment , just so this guy can say he got it direct from the receiving FFL when it's perfecting legal for me to send it along with payment , I'm not going to do that and yes I can sure in the world take my money else where which is what I did
Just have your FFL Guy register on Gunbroker and put all his info there.Then they get it automaicly
as far as I know.Every gun I have bought on GB has worked that way.

I don't know how many times i have to say this BUT my FFL guy is on Gunbroker , he has his FFL register on gunbroker as you put it , that WAS NOT GOOD ENOUGH FOR THIS SELLER,, he would not accept the FFL from gunbroker it had to be sent direct from my FFL guy,

If this is such a big deal to you, then quit buying guns on gun broker and get them locally. End of issue.
Otherwise, deal with it.
There is always someone who will try to belittle another for asking a reasonable, interesting and legitimate question on forums such as this. Did you get up on the wrong side of the bed this morning? Peachead is an appropriate handle that you have chosen for yourself, grumpy. If my comment bothers you, deal with it.

The buyer cannot get his money back unless the seller is willing to take it back and the seller will probably charge the buyer a hefty "restock" fee and the buyer has to pay the shipping back.

The gun is technically "owned" by the FFL as soon as he logs it into his A/D book. The FFL can work with the denied buyer by buying it from him (the buyer will pay big time for that because of what the FFL will offer), or the buyer can consign the gun to the FFL to sell for him, again the buyer will pay for that. What the FFL should not do (and I will never do it and I have been in this situation and have been asked) is to sell/transfer the firearm to the persons wife/son/daughter/uncle/etc. or to a "friend" because of the distinct possibility of a straw purchase happening.

In PA, if a person is denied, I explain to them how to challenge the denial if he knows that he has done nothing to be classified as a prohibited person. I will ask if he wants to tell me anything that I might be able to say you have a good challenge case or sorry, that is a prohibiting offense and try to explain it to them.

As a former FFL Holder I would give a copy of my FFL to people to send to the selling FFL but wrote on it "For transfer only to " their name" Not for Face to Face transfer. Never had a problem

Nope, just stating a fact. Not belittling anyone.
The OP didn't like a seller's policies, he doesn't have to use that seller. Sounded like he was more grumpy about it than I was.
And for the record, peaches have nothing to do with being grumpy, so that makes no sense.

I see nothing inappropriate in your response. It is a viable option….. don't complete the sale!
