Regarding Post #25, from MikeJ. I remembered part or all of the story from the past. I looked it up by doing a search. The title of the thread was "the gunslinger effect" On July 3rd 2022. Post #18 tells about this situation and what happened.
I don't feel your question is anything, but asking for more information. It's there in his words. We can agree or disagree with what should have been done. In this case what was done resulted in an arrest and or court case according to the poster.
Thank you kmoore. The reason I stated I wasn't trying to argue is often people on the boards ask for links-proof when they don't believe someone or are disagreeing.
You did some good detective work.
Not going to attempt to answer the OP's question but I find myself wondering how important it is to be the first to call police & make a report after the incident.
 
First, as soon as someone starts screaming at me, he is kept within my field of vision. I'm not an easy person to attack successfully if not surprised- even though I am not a big guy- so the answer would be moot in my case.

However, as long as you have a CCW you have every right to PULL and point the weapon. However, SHOOTING is another question for the courts- you would have to prove fear for your life. As you describe the attack and the person on the ground is at least partially disabled and also the stranger was acting. irrationally. I think the shooter would get off, if it went to court at all. I would probably would take the shot if the gun doesn't scare him off quickly because I wouldn't want to take the chance of having him grab it from me.

PS: though not part of the question, always good to carry other alternatives. I carry 3 of them, sometimes 4- but not all places have become as less safe as mine has.
 
I agree , people are responsible for their animals.
But I have to say.
I have had everything from cats ( not my choice ) , dogs , horses , hogs , goats , sheep and cattle.
They get out once in awhile. That doesn't make you a bad person , or mean that you don't love or are ilresponsible about your animals.
It happens.

Maybe its just me and my too many years working in a prison, but there's no way in hell that I would turn my back to an unknown person screaming at me. My undivided attention would be entirely focused on him until it was no longer necessary. He's not going to get behind me unknowingly.
 
How? One is an older semi disabled person on the ground completely at the mercy of the attacker. The other is a physically able person perfectly capable of disengaging from the situation.
Obviously you don't know what the term means.
 
Lets just back up to your first mistake.

1. If you LOVE your animal, no matter what animal it is, KEEP IT AT HOME.
Dog got away

2. If you ignored that common sense curtesy, then walk to the front door and knock on it. Politely explain the situation to the home/land owner and ASK THEIR PERMISSION to proceed and ask if they have any preference how you may use THEIR PROPERTY and achieve your goal.
Dog entered property from the back, not the front.
3. Probably won't be any need for any of the rest of those consequences of your mistake at point #1.

4. a warning, I wouldn't suggest you get out that gun and start waving it around after dark while trespassing and yelling about some dog.
You are ignorant of the FACTS. No where did I say that I was waving a gun around. As I explained, I was attacked leaving the property and fell into a public street.
 
Sometimes dogs just bolt. We had one that would do that. It was a stray that took up at my wife's niece's house. She talked us into taking it. If it saw an opportunity it would take off. I followed it down the road going into other people's yards a couple of times to get it back.
 
Dogs sometimes get away. Blaming the dog owner is like blaming the woman who is raped wearing a sexy dress. You don't sucker punch a guy from behind. I am well over 70, on blood thinners and any punch can be fatal. You pull a gun to stop the attacker and that may require using it, perhaps not. If the attack stopped I wouldn't shoot. Will solve the case in court if need be. You don't pull a gun to kill but to stop an attack. Hopefully I am never in that position.
 
I agree, I think you have the right in the described situation, but not in just any altercation where someone is yelling at you or even threatening you.... people say stupid things when they are mad.... and a lot of hot heads don't even realize they are talking s#!t.

As for the 911 call... first you need to take a breath and think about what you are going to say... at the same time you need to look around and see who else is calling 911... if you have a phone it might not be a bad idea to also photograph any witnesses..... first thing is to request and ambulance for a person who has been shot.... don't admit to anything but describe yourself and that you will be visible and waiting for the law. What ever you do don't have a gun visible when the police show up.

I have a dog that is an escape artist.... somedays he is a real pain but I love him.
 
Most of the magazine to the chest, remainder to his face. Then I'm going to change mags and go see if anyone ELSE in that house has a problem with anything. Anything at ALL. Don't piss me off like that, I'm just trying to be a good dog owner and keep after my dog. You assault me? Game on...
