Car insurance story !!!

So here's a story for ya'll:

At the beginning of June my wife was on a road. Three lanes in each direction. She was in the far left lane next to the median. It was not busy at all.

Some woman pulls out and turns right. This driver went all the way over into the far left lane and hit my wife on the back wheel and fender above and behind the wheel.

The right rear wheel. It was clearly the other drivers fault and nobody is questioning this fact.

The police were called but refused to come. They said just trade info and go home. It was a nice Sunday afternoon. Not sure why they didn't want to send a patrol car.

But my wife's back hurt so she went to the emergency clinic. (Our doctor's office will NOT handle auto accident injuries.) which is a whole other story.

So this woman's car insurance is some rinky dink online company. But get this! Her policy expired back in April.

My wife called the police later and told them about the expired insurance. They told her there is nothing my wife can do. And even if they would have shown up on the day of the accident they wouldn't have done anything about it.

So our insurance (State Farm) is handling everything. The car is almost done getting repaired.

My wife finally got ahold of the other drivers insurance. They phoned her twice to tell her that policy is expired and they won't do anything.

I wondered why they called twice. Both my wife and I thought it was to trap my wife into saying something to let them off the hook. I don't know. It was strange.

Anyway, we had to pay the deductible for our insurance but it was easier to do that and have them handle everything.

But what a joke! I cannot figure out why you even need car insurance.

This woman was driving a car with temporary plates. She just bought the car (not new but used) because she had recently been in another accident before this one. This is what she told my wife.

Sorry if this was too long. I just thought it was interesting. My wife has spent hours and hours calling the insurance and car repair shop.

Thanks. My wife is all back to normal. She wasn't speeding because the air bags didn't go off.

But yeah, I'm just exasperated at the breakdown of our system. From the lack of the police response to the fact that this woman could just skate without any consequences.

Although my wife has told my our insurance will go after her. Or if they don't, they will sell the loss to a collections agency. I hope!
 
She tried. She called the police non emergency and talked to the desk manager. They told her it wouldn't make a difference.

This brings me back to my question, why do I need car insurance?

It's clear that this woman, who was recently in another crash before my wife, needed insurance to buy a car, and then either canceled it, or let it expire.

And for the record, I'm NOT going to drop my insurance. Yes I know I need it to cover either myself or someone else if I'm in a wreck.
 
Edited. My wife called to police after the fact to have a police report just to have something on record. Something that our insurance can refer to in order to get this woman to pay.

Also, I'm not upset with the police. Both cars could drive home, and I do understand there are far more crashes than police able to respond. I'm not anti-police.

Im just upset with the insurance system. It's been a nightmare to get them to pay for the repairs. But yes, they are paying. Finally!
 
Wife had a similar experience an uninsured hit her and little damage was done. She called the police, and two tickets were given to the uninsured driver. Some of the benefits of living in a small town. We paid the deductible BUT the Insurance Co/State Farm. took the driver to court and had her pay our deductible.
The reason you have insurance is for what happened to your wife. It could have been BIG $$$$$$$$$$$$$$$$ to fix your ride and you would have been SOL without insurance. That is why you have uninsured motorist coverage.
ALWAYS get the police to come.

Sweetie really is a good driver. (No she isn't looking over my shoulder.) she was really upset when her car got hit. It was brand new in January and only has a few thousand miles on it.
 
Another reason you need insurance is, so that if you're at fault in a severe future accident, you don't lose nearly everything you have in a lawsuit. Unless you're like some people, who have essentially no assets that could be attached.
 
You need that police report for the insurance to file as uninsured motorist (ask me how I know, plus I am in Texas and have State Farm like the OP). State Farm should be who pursues the offender. A confirmed uninsured motorist claim does not raise your rate but you're out the deductible for sure. I am not shy about my disdain for insurance (not much different than politicians, in fact ... most small town mayors ARE insurance brokers) but if there's worse, it's bad cops.
 
I also have State Farm and have been involved in a couple of incidents involving uninsured/under insured drivers. I just turn it over to State Farm with the comment "Someone's going to pay for this and you have legal staff to handle it". Has worked every time. In one case, a drunk driver hit our vehicle while it was parked in FIL's driveway. State Farm covered the damage but it took close to three years for them to get reimbursed by the drunk driver(who spent several months in jail over the incident).
 
My wife and I just had a discussion about how many people are likely driving around without insurance coverage right now. It's one expense strapped families can eliminate and not see a consequence until tag time in my state of Kansas.

The upside is you were insured with State Farm, one of the largest companies out there. The downside is there is only so much they can and will do. They will likely just pay and move on as so many of these pile up.

Not sure of what state you live in but this is a national problem and it is only going to get worse.
 
Always say that you may be injured when you call the police. They have to respond to injury crashes.
That is what I told all my kids when they started driving. If you're in an accident and its clearly not your fault, something hurts and you need an ambulance. Especially on private property like a huge parking lot. You should be in Illinois where cops' hands are so tied I don't know why anyone would ever consider doing that for a career.
 
In Texas, one can file an accident report, cops or no cops. If you call the cops and they don't respond, ask your insurance company how to do that when you contact them. I mean, you did contact them, right? That's usually the 2nd or 3rd thing you do, you know, right after checking for injuries, getting to a safe area, etc....And FWIW, having an auto accident is a civil matter, not a crime. In other words, if no one is injured and both vehicles are still operable, don't be surprised if the cops don't show up. You are however, required by law to exchange insurance info with the other party. Also get their DL info and/or their license plate number....ain't your job to contact the other parties insurance company, but nothing says you can't try. That might work for you, might not....Far as all that goes, some insurance companies provide a form for reporting accidents along with the other paperwork they send when you join up. That might be something you'd want to check into for next time.

IMO you should be upset with the police.. That was an arrestable offense. They did not have to respond to make an arrest
