Ruger Max 9 discharge.

I did a search maybe I'm not typing the correct phrase.
My brother purchased a brand new Max 9.
Last night while in an OWB holster. It discharged in a public restaurant.

He wasn't touching it it any way. Just walking.
Inspected the holster. Nothing inside the holster could have pulled the trigger.

Law enforcement took the Max 9 and sending it to our state agency to see if it was modified which is hasn't been.
One officer said the state may keep the max 9 and revoke his carry permit.

Just wondering if anyone has heard of this before with Max 9's.
Pretty scary situation. Never seen anything like this in my life. Closest thing I ever seen was a Springfield xds fire after chambering. Which later was a recall.

My Max-9 is my EDC gun and it has been very reliable. Couple of questions to help figure what happened. Not trying to put any blame out, just concerned since I carry the same.

Was his a Pro model or did it have a safety? If safety model, was safety on? Mine has the safety, and I check it every time I remove it from my holster to make sure it hasn't been bumped off. I carry in a Simply Rugged Cuda which covers the trigger. What kind of holster was he using.

Be interested to hear what the state agency comes up with. Regardless, that's a scary situation. Hopefully no one was hurt.

His had a safety. The holster is an IWB Kydex. I believe it may be a We the people holster. Not 100 percent on the brand. Trigger is fully covered.

Is a max 9 striker or hammer fired? Either way I'm thinking a defective sear that let go on its own from movement or bumping or something. Was the safety on?

Striker fired. He said safety was on.

We are two different type my brother and I.
I don't care for a safety and he does.
I won't carry unless chambered and he's always been skeptical of having it chambered.

His thoughts on having it chambered all changed a few years back when we boxed in a guy that had stole one of his work trucks.
I was carrying a Ruger American.
He was still caring an SR40c and bc he couldn't get it to chamber.
I a had already told him to send the factory mag back bc I had one of the SR40c and it would do the same. Ruger sent a new mag and never had another issue.

Did the police also take the holster it was in when it discharged ?
If not , how can they do a complete investigation on what exactly made the gun fire ?
Yes. From my understanding. I believe the state will investigate that.

He is hoping to send it to the manufacturer if the state doesn't. Of course he'll probably never carry it again anyways

Speaking from personal experience, it is entirely natural (and sensible) to lose confidence in a gun that malfunctions in a hazardous manner. I've had that happen with two firearms: the foreign-built rifle was repaired and then sold, the American-made rifle went back to the manufacturer (not Ruger) for a refund.

Good question. I carry a Taurus G2C which is striker fired but the striker is 'in neutral' until triggered.

UPDATE
My brother was told to come get his Max9 and his CWP from the Sheriff's office on Monday.
He doesn't know if anyone inspected it or just held it bc that's protocol.

So he will be sending it to Ruger for an inspection. Just in case there is some sort of flaw.

I would like to know what Ruger had to say about this as I have a Max 9 myself. This incident has me concerned about carrying it. Please let us know the findings from Ruger.

Wonder? Like is this just more Ruger bashing? I kinda was thinking the same thing. I see a lot of negative feedback on the LCPMax but very little on the Max9. I also find it odd the LEO returned the firearm without inspection reports. JMHO
